Employers’ liability and asbestos claims

In the last issue of Insurance Law Monthly there was some discussion of the problems of allocating liability for mesothelioma claims between employers and their liability insurers. The asbestos problem has reached the courts in other forms. In T&N Ltd v Royal and Sun Alliance plc [2003] EWHC 1016 (Ch), [2004] Lloyd’s Rep IR (forthcoming) Lawrence Collins J considered a series of issues concerning the proper construction of such policies, and the operation of the Third Parties (Rights against Insurers) Act 1930.
