Allocating reinsurance recoveries within a pool

In North Atlantic Insurance Co Ltd v Nationwide General Insurance Co [2003] EWHC 449 (Comm), Cooke J addressed, as preliminary issues, a series of complex questions concerning the reinsurance procured by the manager of a reinsurance pool for the benefit of its members. The questions were numerous and complex, although it is possible to distill some general principles from the reasoning of the Court.
