The decision of the Court of Appeal in Scott v Copenhagen Reinsurance Co (UK) Ltd [2003] EWCA Civ 688 (forthcoming in [2003] Lloyd’s Rep IR) is yet another instalment in the long saga that has been generated by the seizure of Kuwait International Airport by Iraqi forces on 2 August 1990. The appeal was concerned purely with the fate of one BA aircraft, although the judgment of Rix LJ contains a detailed analysis of the term ‘event’.
