Aggregation of losses

The decision of Tomlinson J in If P & C Insurance Ltd v Silversea Cruises Ltd [2003] EWHC 473 (Comm) (forthcoming in [2003] Lloyd’s Rep IR) appears to be the only case to date to reach the English courts on the liability of insurers for losses arising from the New York attack on 11 September 2001. Much of the ruling was concerned with the construction of the policy, although Tomlinson J was required to resolve aggregation issues for the purposes of determining the maximum amount recoverable under the policy.
