Aggregation of incidents of loss

Aggregation arose in yet another guise in the decision of David Steel J in Midland Mainline Ltd v Commercial Union Assurance Co Ltd [2003] EWHC 1771 (forthcoming in Lloyd’s Rep IR). This case arose out of the Hatfield rail disaster on 17 October 2000, and was a claim by various train operators against their business interruption insurers.
