The transit clause

The decision of David Steel J in Bayview Motors Ltd v Mitsui Fire and Marine Insurance Co Ltd [2002] EWHC 21 (Comm), considered in the September 2002 issue of Insurance Law Monthly, has been upheld by the Court of Appeal ([2002] EWCA Civ 1605), albeit on slightly different grounds.The case considers the meaning of the word ‘seizure’, which is an exclusion from the standard cargo cover available in the London market.
