Pensions mis-selling

The decision of Morison J in Countrywide Assured Group plc v Marshall [2002] EWHC 2082 (Comm), forthcoming in [2003] Lloyd’s Rep, is a further addition to the fast-growing jurisprudence on the meaning of the terms ‘occurrence’ and ‘cause’. The decision also discusses the relationship between aggregation for the purposes of determining how many deductibles the assured is to bear and aggregation for the purposes of fixing the maximum sums due under the policy.
