The recoverability of ATE premiums

The House of Lords, in Callery v Gray [2002] UKHL 28, forthcoming in the October issue of [2002] Lloyd’s Rep IR, has for the first time considered the impact of after the event insurance on small-scale personal injury litigation. By a majority, the House of Lords has confirmed the approach taken by the Court of Appeal in its two judgments in this case ( [2001] Lloyd’s Rep IR 743 and 765), but has done so with extreme reservations.
