(Svenska Handelsbanken AB v Dandridge [2002] EWCA Civ 577)

The Svenska case, the only one to reach the Court of Appeal, was a claim by a bank under a mortgagees’ interest policy. The right of the bank to recover was, however, dependent upon the coverage of the assured owner’s war risks cover. The case was determined on preliminary issues, and the facts were assumed for the purposes of the judgment.
