Marine insurance - Seizure

(Bayview Motors Ltd v Mitsui Fire and Marine Insurance Co Ltd [2002] EWHC 21 (Comm))

As noted earlier, the usual structure of cover for seizure in the London market is that the peril is excluded from marine risks policies but is included in war risks policies (subject to the various exclusions discussed above). In Bayview Motors Ltd v Mitsui Fire and Marine Insurance Co Ltd [2002] EWHC 21 (Comm) a claim was made against marine insurers for loss of cargo, and the issue there was whether there had been a ‘seizure’ within the meaning of that word.
