The point arose briefly in Bestquest Ltd v Regency Care Group Ltd , 18 January 2002, unreported, a decision of HHJ Hallgarten QC on preliminary issues in the Central London County Court. Insurance Law Monthly is grateful to Alison Green of 2TG for the transcript.
