Intermediaries - Advice as to identity of insurers

(Frost v James Finlay Bank Ltd, [2002] Lloyd’s Rep IR forthcoming)

In the June 2002 issue of Insurance Law Monthly the decision of Hart J in Frost v James Finlay Bank Ltd [2002] Lloyd’s Rep IR 429 was considered. Shortly after the issue went to press, the Court of Appeal, in Frost v James Finlay Bank Ltd [2002] EWCA Civ 667, reversed the ruling of Hart J. The reversal was mainly on the facts, and the principles of law involved are largely unaffected.
