In Co-operative Retail Services Ltd v Taylor Young Partnership [2002] UKHL 17, forthcoming in [2002] Lloyd’s Rep IR, the House of Lords has attempted to clarify the rules relating to subrogation as against co-assureds. Ultimately the case turned on principles of contract construction, but their Lordships’ comments are nevertheless useful.
