Policy Conditions - Reasonable Care Clauses

(Hayward v Norwich Union Insurance [2001] Lloyd’s Rep IR (forthcoming))

The decision of Judge Tugenhadt QC in Hayward v Norwich Union Insurance [2000] Lloyd’s Rep IR 382 caused more than a little apprehension, as its apparent effect was to render meaningless policy conditions which were clearly drafted and which were designed to require minimum security precautions to be taken by the assured in the protection of his high-performance car. The Court of Appeal’s reversal of that ruling, in February 2001, forthcoming in [2001] Lloyd’s Rep IR, will doubtless be greeted with some relief.
