Charterparty – Speed and consumption warranties – Whether allowance should be made for “about” – Whether “good weather” qualification in pro forma charterparty expressly incorporated – Whether performance warranties subject to implied “good weather” qualification

A speed and consumption dispute arose under a time charter of vessel X. Issues arose as to whether an allowance should be made for “about” on the speed and/or consumption warranties in the charterparty, whether the “good weather” qualification in a pro forma charterparty was incorporated into the present charter and applicable to the performance warranties, and if not, whether the performance warranties were subject to an implied “good weather” qualification.
