The facts

During 2008 Combined Stabilisation Ltd (‘CSL’) were engaged by Jim Ennis Construction Ltd (‘JEC’) to undertake ground works at a site in Wigan. CSL’s works were completed on or around 12 May 2009 and subsequently the parties entered into negotiations in an attempt to settle CSL’s Final Account.
