US court prevents personal injury claim circumvention

The American Tort Reform Association has applauded the Maryland Court of Appeals for ruling that the state’s limit on non-economic damages applies to lawsuits brought under the state’s Consumer Protection Act (CPA). In so doing, the court affirmed the reduction of a $2.3mn verdict to $515,000 in Green v. N.B.S., Inc.
