In Amaryllis Ltd v HM Treasury [2009] EWHC 962 (TCC), [2009] All ER (D) 101 (May) Mr Justice Coulson held that the defendant was not entitled to strike out the claimant’s claim that there had been a breach of regulation 47(7) of the Public Contracts Regulations 2006 (SI 2006/5). On the facts of the case the claimant was held to have provided written notice of the breach and of its intention to bring proceedings and that it had brought its claim promptly and within three months from the date when grounds for the bringing of proceedings first arose.
