Lump sum for catastrophic injury not periodical payments
A passenger injured in a car crash accepted that his damages should be reduced for contributory negligence by reason of his
failure to wear a seatbelt, and by reason of his decision to ride as a passenger in a vehicle that was driven by an uninsured
driver. The settlement was approved by the court, but a judgment was not given on liability. The passenger’s solicitors considered
that the final settlement was reached on the basis that other driver was liable for between 25% and 30% of the damages.
