Agency worker and unfair dismissal claim

The claimant worked for a council as an agency worker from September 2001 until September 2004. When she returned to work following a period of sickness absence (during which the agency supplied a replacement worker) the council decided that it no longer required her services. There was no express contract between the claimant and the council, and the contract between the claimant and the agency stated that she was self employed.
