Whether US Coast Guard had jurisdiction to investigate collision on high seas between foreign vessels
Officers of a foreign vessel brought proceedings against the United States Coast Guard challenging the investigation of a
collision on the high seas between two foreign vessels. There were a number of US citizens on board, but there were no injuries
and no fatalities. The officers applied for a temporary restraining order or preliminary injunction prohibiting the US Coast
Guard from investigating the collision. Sub-section 6101(e)(1) of 46 USC section 6101 provided:
