Carriage of goods by sea - Whether time-charterer a “carrier” within meaning of Hague Rules

The plaintiff cargo interests claimed damages in respect of the contamination of their cargo of raw bulk sugar resulting from the ingress of salt water into the holds of the vessel Violetta while en route to Australia to Saint John, New Brunswick. The issue on appeal was whether Fednav Ltd, the time charterer of the vessel, was a carrier within the meaning of the Hague Rules.
