Nelson Pine Industries Ltd v Seatrans New Zealand Ltd (The “Pembroke”) - High Court (Ellis J) 10 August 1993

Cargo claim - Cargo stowed on deck - Whether carrier entitled to rely on package limitation provisions of Hague-Visby Rules

The plaintiffs purchased certain goods which were to be carried from Bremerhaven, Germany, to the Port of Nelson, New Zealand. The goods were carried in the vessel Pembroke . The defendants were the New Zealand agent and legal representative of the Master and the owner or charterer of the Pembroke for the purpose of receiving and paying claims for damaged cargo under section 11 of the Sea Carriage of Goods Act 1940.
