In these proceedings Caltex Refining Co Pty Limited (“Caltex”) as the owner of a cargo of automotive diesel oil (“ADO”) sued BHP Transport Limited (“BHP”) for contamination which had occurred to the ADO on carriage from Singapore to Sydney on board BHP’s vessel Iron Gippsland ).
