Evmar Shipping Corpn. v. Japan Line Ltd. - Q.B.D. (Com.Ct.) (Leggatt J.) - 19 June 1984
Arbitration award - “Successful” claimants ordered to pay respondents’ costs
In 1976 a vessel was re-delivered to her owners by charterers. Some fifteen months later, in June 1977, the owners notified
the charterers of a claim for stevedore damage. In October 1977 the charterers, having investigated the matter so far as they
could, rejected liability. In May 1980 the owners appointed an arbitrator. In April 1984 an award was published whereby the
owners were awarded 2,250 Dutch guilders, equivalent to less than £600. The arbitrators ordered the owners to pay the costs,
including the costs of the award.
