SAMIR v. Notos Maritime Corporation of Monrovia (The Notos) - Q.B.D. (Com.Ct.) (Leggatt J.) - 21 May 1984

Demurrage - Delays in berthing/discharging under STB VOY

The vessel Notos was chartered on the STB VOY form for the carriage of crude oil from Ras Tamura to a sea-line at Mohammedia. A dispute arose as to demurrage. The vessel arrived at Mohammedia at 12 45 on 5 February 1982 and gave notice of readiness. A little while later she anchored at the customary anchorage. On 25 February, at 11 50, another vessel moored at the only sea-line. The other vessel moved off the sea-line on 28 February and the Notos shifted and connected to the sea-line at 12 30 that day. Because of swell, the Notos was required to wait off the sea-line between 2 and 7 March.
