Voyage charter for lump sum freight - Whether diversion during voyage constituted deviation

The vessel was chartered to carry a cargo of fuel oil from the Caribbean to one Far East port. The charter provided that the ship was to perform the voyage via the Panama Canal and that a lump sum freight of $700,000 was payable upon delivery of the cargo. By clause one of the charter the ship, once loaded, was to “forthwith proceed, as ordered on signing bills of lading, direct to the discharging port(s) . . . and deliver said cargo”.
