“Safe port” arbitrations challenged

These applications arose out of two related arbitrations, both arising out of the same incident. The vessel Vimeira had suffered serious rudder damage at Rodenhuizedok in Ghent in December 1980 when manoeuvering at the dock entrance with a pilot embarked. The main issue was whether Rodenhuizedok was a safe port for the vessel or alternatively whether it was a place where she could always safely lie afloat.
