Whether agent liable for misrepresentation under Misrepresentation Act 1967

This was a preliminary issue of law relating to the interpretation of Section 2 of the Misrepresentation Act 1967. The plaintiffs had purchased the vessel Skopas from the third defendants and now claimed that they had been misled into making the purchase by incorrect representations about the passing of a special survey in the comparatively recent past, and about maintenance and repair said to have been performed on behalf of the sellers.
