In South Caribbean Trading Ltd v Trafigura Beheer BV [2004] EWHC 2676 (Comm); [2005] 1 Lloyd’s Rep 128 Mr Justice Colman cast doubt on the correctness of the decision of the Court of Appeal in Williams v Roffey Bros & Nicholls (Contractors) Ltd [1991] 1 QB 1. In so concluding he demonstrated that the doctrine of consideration does still have a role to play in modern commercial transactions, in particular in the context of the renegotiation of contracts..
