COURT PROBLEMS FOR NEW INDIA ASSURANCE

A New India Assurance appeal against a Rp68,500 award from the Motor Accident Claims Tribunal (MACT) has been thrown out by the Bombay High Court because the insurer did not obtain leave of appeal from the MACT. The court fined New India Assurance an additional Rp25,000 for falsely claiming that it had been given leave to appeal, reports Express India . New India Assurance claimed that the situation was a result of a drafting error. It said that the award remained too high, since the bus driver injured was covered by a policy with a cap of Rp15,000, and that the injury did not merit the award.
