Increased limitation period proposed in Scotland
The Scottish Law Commission has recommended that the limitation period for personal injury actions be extended from three
years to five years – in a move which it says is aimed at helping claimants and their representatives. The recommendation
comes in a report from the Commission published recently. The Commission thinks that allowing a longer period will be welcomed
particularly in cases involving claims for occupational diseases, where gathering evidence to bring an action can be very
time consuming and difficult.
