Injured passenger in boot of drunk driver’s car
Contributory negligence discount was set at 30% for a claimant injured as a passenger riding in the boot of a vehicle driven
by a drunken friend. He had volunteered to ride in the boot, a decision that it was found had materially contributed to his
injuries. The Court found that all of the passengers were aware or should have been aware that the driver was in no fit state
to drive.
