Care home abuse claim out of time
A claimant seeking damages after suffering sexual abuse at a care home and whilst resident at a detention centre has failed to win his case before the Court of Appeal, as the claim was not brought within the appropriate three year timescale, and the court was unwilling to exercise its discretion to allow the claim to proceed out of time. The case illustrates that limitation issues in abuse and assault cases remain contentious and unresolved, say lawyers at Beachcroft.
