Periodical payments and the Average Earnings Index
The defendant applied to strike out a part of the claimant’s statement of case that argued that periodical payments should
be subject to the Average Earnings Index (AEI) and not the Retail Prices Index (RPI). The application was dismissed. The defendant
appealed.
