4.1 Similar to many other countries Germany does not have specific laws dedicated to procurement and tendering for private construction works,1 any issues in relation to procurement and tendering are purely governed between the parties and subject to contract law. For procurement and tendering of public construction works in Germany, substantial laws and regulations exist; not only does German law apply, but also European public procurement law. The hierarchy of public procurement law in Germany is as follows:
