Decision of adjudicator not meaningless

Grid Solutions Ltd and Amey Power Services Ltd v Scottish Hydro Electric Transmission plc [2024] CSOH 5

In Grid Solutions Ltd and Amey Power Services Ltd v Scottish Hydro Electric Transmission plc [2024] CSOH 5, Lord Richardson held that the pursuers were entitled to enforce the decision of the adjudicator. He rejected the defender's submission that the adjudicator had failed to consider a material defence which had been relied upon by the defender, that the adjudicator had failed to give reasons to support his decision and that his purported award was meaningless and unenforceable. While the decision of the adjudicator clearly contained errors in the section of his decision in which he ordered that payment be made to the pursuers, it was held that any reasonably informed reader of the decision would not have had any doubt that the adjudicator was ordering the defender to pay the sum of £1,834,573.43 within seven days of his decision.
