Additional damages not punitive
In awarding additional damages under section 97(2) of the Copyright, Design and Patents Act 1988, it was not appropriate to
include a purely punitive or exemplary element. But the section was drafted in wide terms so as to permit aggravation awards
on far wider factors than at common law.
