Follow the settlements

Facultative contracts are generally proportional and also generally written on a back-to-back basis. They also for the most part contain follow the settlements clauses. Stronghold Insurance Company Ltd v Bulstrad Insurance and Reinsurance plc, an unreported decision of His Honour Judge Mackie QC, of 24 November 2006, discussed both the meaning of follow the settlements and also the scope of back to back cover. There is no official transcript, and the following account is taken from an unofficial transcript of the extempore judgment delivered by HHJ Mackie QC.
