Application of reinsurance deductibles

In Allianz Marine Aviation (France) v GE Frankona Reinsurance Ltd London, The Treasure Bay [2005] EWHC 101 (Comm) Christopher Clarke J was asked to construe a deductible clause in an excess of loss reinsurance agreement on a marine risk. The question in outline was whether the deductible applied to the assured’s claim or to the reinsured’s proportion of that claim.
