Exclusive jurisdiction clauses

In S tandard Steamship Owners’ Protection and Indemnity Association (Bermuda) Ltd v GIE Vision Bail [2004] EWHC 2919 (Comm) the question for Cooke J was whether an exclusive jurisdiction clause contained in the rules of a P&I club was binding. Two separate issues arose: did the clause by its terms extend to the assured; and, if it did, was it deprived of effect by European Council Regulation (EC) No 44/2001?
