Claims control and the meaning of ‘loss’

The Court of Appeal, in Dornoch Ltd and others v Royal and Sun Alliance [2005] EWCA Civ 238, has upheld the decision of Aikens J, reported at [2004] Lloyd’s Rep IR 826 , in ascertaining the correct meaning of a claims control clause attaching to the reinsurance of a directors’ and officers’ liability cover. The judgment is considered by David Turner of 4 New Square.
