The nature of time variable and shortfall cover

(Screen Partners London Ltd v VIF Film Production GmbH & Co [2002] EWCA Civ 2096)

The film finance cases which are presently making their way through the courts have raised a variety of complex issues relating to the general law of insurance. The very nature of this form of insurance fell to be decided by the Court of Appeal in Screen Partners London Ltd v VIF Film Production GmbH & Co , to be reported in [2002] Lloyd’s Rep IR. The Court of Appeal ruled that the questions before it could not be determined without a full trial and expert evidence.
