Aggregations - Acts or omissions in professional indemnity policies

(Lloyds TSB General Insurance Holdings Ltd v Lloyds Bank Group Insurance Co Ltd and Abbey National plc v Lee, October 2000, forthcoming in Lloyd’s Rep IR)

The issue before Mr Justice Moore-Bick in the joined cases Lloyds TSB General Insurance Holdings Ltd v Lloyds Bank Group Insurance Co Ltd , and Abbey National plc v Lee , October 2000, forthcoming in Lloyd’s Rep IR was whether individual allegations of pensions mis-selling against the assured companies were for insurance purposes to be aggregated or whether they amounted to separate claims against the companies. The point was significant in the present case in determining how many deductibles were to be borne by the assureds. The cases proceeded upon assumed facts, and were concerned only with the preliminary issue of the proper construction of the insurances involved.
