Aggregations - “Occurrences” in property policies

(Mann v Lexington Insurance Co, October 2000)

The decision of Mr Justice Timothy Walker in Mann v Lexington Insurance Co (decided June 2000), discussed in the August 2000 issue of Insurance Law Monthly, has recently been overturned by the Court of Appeal, October 2000. The appeal decision once again demonstrates the problems in ascertaining the meaning of generalised words of aggregation, such as “occurrence”. The case was concerned only with preliminary issues on assumed facts.
