Insurance (motor) - Consolidated Motor Insurance Directive, Directive 2009/103/EC - Motor Vehicle (Compulsory Insurance) (Information Centre and Compensation Body) Regulations 2003, SI 2003/37, Regulations 12 and 13

The claimants were injured in a motor accident in Lithuania, the fault of the driving of a Lithuanian national. At the date of the accident the driver had no insurance. The question was whether the amount payable by the Motor Insurers' Bureau was to be assessed under English law or Lithuanian law (the latter imposing a cap).
