The facts
During 2003 Merit Process Engineering Limited (‘Merit’) entered into negotiations with Balfour Beatty Engineering Services (HY) Limited (‘BBES’) for three separate sub-contract work packages for plant and pipeworks. The first two packages, referred to as the Main Installation Package and the Vacuum Drainage Package, concerned the Diamond Synchrotron Project at Chilton in Oxfordshire. The third package related to the Isis Project at Didcot. Both projects were for the construction of scientific and research facilities.
