The facts

A, the respondent, was the owner of the Fesco Angara and had time chartered it to B. O, the appellant, had supplied bunkers to the vessel while it was under that time charter. Under the time charterparty, B was to provide bunkers. B redelivered the vessel early to A and as stipulated by the time charterparty, A gave credit to B for the bunkers. B had not paid O for the bunkers.
