Fraudulent insurance claims

The Law Commissions have invited comments on an Issues Paper on fraudulent claims. Although Issues Paper 7 is entitled ‘The Insured’s Post-Contract Duty of Good Faith’, its main topic is fraudulent claims. What follows is a summary with a few comments.

The Law Commissions first provide an overview of the current state of the law and then go on to cover the definition of fraud; the appropriate remedy for fraud; the law applicable to co-insureds and group insurance; and close with a general overview of the post-contractual duty of good faith. The Law Commissions then go on to provide their proposals for reform, and close with a list of questions to which responses are requested.
