The facts

The MV Lowlands Orchid loaded bulk coal from Richard’s Bay Coal Terminal and discharged part of its cargo at Rotterdam between 19 and 22 December 2007 and the remainder at Immingham between 23 and 28 December 2007. It was at the time under a voyage charterparty between the appellant owners and the respondent charterers.
